The “Surinder Singh” immigration route meant that foreign nationals who were living in the EU or EEA with a British national could come to live in the UK under the EU Settlement Scheme Family Permit.

The immigration route was created following a High Court case in 1992, which ruled that freedom of movement included the freedom to return to your home country and that eligible family members could come with you.

While this route was closed on 29th March 2022, late applications will be considered under certain circumstances.

Late applications

With the closure of this immigration route, both British citizens and their qualifying family members should have returned to the UK before 29th March 2022.

These include:

  • Delays in receiving the family permit. Applications should be made as soon as possible and generally within three months of arriving in the UK.
  • Work commitments. Applications will be considered if you were working in an EU/EEA country and the contract ran beyond 29 March 2022.
  • Studying. Delayed applications will be considered if you are studying in an EU/EEA country that ran beyond 29 March 2022.
  • School terms. The application may be delayed if you have a child at school in an EU/EEA country and the term runs beyond 29 March 2022.
  • A serious illness, medical treatment, pregnancy or maternity. This may stop you from flying and delay travel beyond 29 March 2022.
  • Adoption. If you are adopting a child, this process may delay your ability to travel.
  • Compassionate reasons.
