Our insolvency lawyers in Scotland will be on hand to support you throughout the insolvency process. Getting good advice early can provide quick, decisive, and effective solutions for businesses, lenders, creditors, directors, and individuals.

There may be fees involved in declaring yourself insolvent, but we will discuss these with you. In most cases, we operate on a fixed rate. If this is not possible, we will give you an estimate.

Commercial advice can help businesses avoid or navigate insolvency by offering clear, expert guidance on the least disruptive and most cost-effective course of action. Insolvency cases can move at great speed and we always advise that you have caveats in place for protection against proactive creditors who are looking to take interim action.

Types of Insolvency

In Scottish law, there are two types of insolvency. These are:

Sequestration.
This is if you can’t pay back your debts within a realistic timeframe. It allows you to write off debts, but you may need to sell valuable assets to cover some of the debt.

Protected Trust Deed Under Bankruptcy.
This is a repayment scheme that lasts 4 years or over and one pays back as much as they can in monthly instalments.
