      Divorce Legal Advice

We recognise that every individual’s situation is different. Our Divorce Solicitors are highly experienced in the complexities of family law matters.

If you think your relationship may end, you need specialist advice and help. In that case, you should seek the advice of a divorce lawyer at the earliest opportunity.

Of course, we understand that making contact with a lawyer is a difficult step to take and you may be at a point where no decisions have been made.

However, we regularly provide legal advice to individuals who have not separated but wish to be aware of their rights and obligations in the event of a potential separation.

At Jones Whyte, we are fully aware that everybody’s circumstances are unique to them and we pride ourselves in the manner in which we guide individuals through the divorce process.

How Our Divorce Lawyers Can Support You With Divorce In Marriage Or Civil Partnerships

When separating from your partner, whether you are married or otherwise, several matters require attention. The most pressing of these are the arrangements for children and financial matters.

Whether you are married, cohabiting or in a civil partnership, it is important to know your rights should the relationship come to an end. Cohabiting couples need to know that they only have one year from the date of separation to make any financial claims. Regardless of the circumstances, early advice from experienced separation solicitors is crucial.

We can provide you with advice regarding:-

      • Fair division of assets and liabilities
      • Child maintenance payments
      • Spousal aliment (payments due to or by a spouse following separation)
      • Re-drafting of Wills or other testamentary provisions

      No-Fault Divorce Scotland

The Jones Whyte Family Law team are committed to empowering our clients with knowledge, especially when it comes to navigating sensitive legal matters like divorce.

In Scotland, divorces operate under a no-fault system, which means couples can seek divorce without assigning blame. Instead, the grounds for divorce revolve around the irretrievable breakdown of the marriage.

      Beginning Divorce Proceedings

Couples can establish this breakdown through four key grounds: separation for one year with consent, separation for two years without consent, unreasonable behaviour, or adultery.

      Supporting Children After Divorce Proceedings

      Child Arrangements & Maintenance

Child maintenance fees will be arranged when you have separated to help cover the child’s living costs when you do not live with the child. Please note that even if you do not live with your child, and even if you don’t see them, you are still responsible for the cost of raising them.

Arranging child maintenance can be done between both parties (that’s if they both agree), or through the Child Maintenance Service. It is advisable to seek guidance from a separation solicitor to help you with separation matters and to provide you with essential advice during the process.

      Separation Agreement

A separation agreement, formally called a Minute of Agreement, is a legal document or contract between parties who have separated. By entering into separation agreements, this allows parties to avoid court proceedings to determine monetary issues.

A Minute of Agreement is formally registered at the Registers of Scotland in Edinburgh. and, after that has been done carries the same force as a court order and can be enforced similarly. Seeking advice from a separation solicitor is recommended, especially in cases where one party has a more favourable financial situation or if the separation is acrimonious. A solicitor can provide guidance on relevant considerations and the division of matrimonial property.

Do I Need To Go To Court?

It is common for most couples who are separating to resolve their matters without going to court, whether through negotiation, mediation, the collaborative process, or arbitration. In some cases, individuals may find it necessary to go to court either immediately or when all other avenues have been exhausted.
