Dental Negligence Case

The Clinical Negligence team at Jones Whyte, represented a client who had suffered from periodontal disease since 2003, but unfortunately, this did not come to light until she was diagnosed in November 2019 when her dentist retired.

Periodontal disease is a condition affecting the gums that can lead to tooth loss.

Our client was advised by the negligent dentist to use mouthwash in previous years and had never referred her to periodontal treatment. As a result of the delay in diagnosing the client, the prognosis of her teeth had become poor, and our expert anticipated that she would imminently lose some of her teeth.

Legal action was initiated as the dentist’s insurer had refused to settle the claim pre litigation. Our clinical negligence team here at Jones Whyte obtained further expert reports to support the client’s claim, and the defendant made an offer to settle the claim at £40,000. We rejected this offer, and the claim settled at £50,000. This settlement has helped cover all the necessary costs of corrective treatment and compensated the client for the pain and suffering endured.
