POWER OF ATTORNEY, EDINBURGH

Expert Power of Attorney Services in the Heart of Edinburgh

A Power of Attorney is one of the most important legal documents you can put in place. It grants your chosen attorney power to make decisions on your behalf should you become unable to do so yourself, whether through illness, injury, or the onset of conditions such as dementia.

At Jones Whyte, our Power of Attorney solicitors in Edinburgh provide expert legal advice tailored to your personal circumstances. We take the time to understand your personal affairs and ensure the document is correctly drafted, certified, and registered with the Office of the Public Guardian Scotland (OPG) – so that when it is needed, it works.

With a dedicated Edinburgh office at 3 Hill Street, EH2 3JP, our Power of Attorney lawyers in Edinburgh are accessible for in-person consultations as well as telephone and video appointments across Edinburgh and the Lothians.

Estate Planning Lawyers

Don’t wait until it’s too late

A Power of Attorney can only be granted while you have legal capacity. If capacity is lost before a POA is in place, a far more costly and time-consuming Guardianship Order through the courts may be the only alternative. Acting now protects your future and your family.

Frequently Asked Questions - Power of Attorney

Unlike in England and Wales, Scottish law under the Adults with Incapacity (Scotland) Act 2000 requires that a Power of Attorney document must be certified by a practising solicitor (or other authorised certifier) to confirm that the granter understands the document and has not been subject to undue influence. Without this certification, the OPG Scotland will not register the document.

Using a specialist Power of Attorney solicitor in Edinburgh therefore isn't just advisable - in practice, it is a legal necessity. Beyond the certification requirement, our Edinburgh POA lawyers ensure your document is correctly drafted, contains appropriate powers and restrictions, and that your chosen attorneys understand their duties and obligations.
